Data subjects
This privacy statement is intended solely for the following categories of data subject:

  • clients and/or agents engaged by them (“clients”);
  • potential and actual applicants for employment (“job applicants”);
  • suppliers (“suppliers”);
  • interested parties, such as visitors to our website or readers of our publications who are not clients (“interested parties”);
  • third parties, such as opposing parties, lawyers, experts, and other persons, the processing of whose personal data is a matter of necessity for us (“third parties”).

Processing your personal data
We use your personal data carefully and appropriately. We treat your personal data confidentially and we apply suitable security measures in order to maintain that confidentiality. We otherwise use your personal data only if there is a legal basis for doing so, as stipulated in the General Data Protection Regulation (“GDPR”).

Retention periods

Your personal data will be retained only for as long as necessary. Details of the retention periods are given below, to the extent possible.

  • Administrative personal data, court proceedings files and advice files are retained for at least seven years, or longer if necessary or if there is a legal requirement to do so.
  • The personal data of job applicants who have not been given a position are deleted four weeks after the conclusion of the application process, or longer if the job applicant has given his or her consent.
  • Personal data issued on a consensual basis shall be deleted as soon as said consent is withdrawn. We may also ask data subjects to reconfirm their consent during the retention period.
  • Other personal data is retained for 18 months, or longer if necessary.

Security

We take appropriate technical and organisational measures aimed among other things at preventing the loss of personal data or the unauthorised processing thereof, including:

  • Our website uses a secure connection.
  • Our servers are properly secured and hosted in the European Union.
  • We use named accounts and a two-stage verification process for access to systems in which personal data is processed.
  • We use physical access checks for server premises in which personal data is stored.
  • We restrict the degree to which personal data may be viewed to persons for whom this is necessary.

Cookies

We use various types of cookie on our website. This could be small harmless text files that monitor whether or not you are logged in, for example. Below is a list of the types of cookie that we use:

Functional cookies:
Session cookies: these cookies serve mostly to monitor whether or not you are logged in and what page you are visiting. They are necessary for the provision of our online services. No permission is required for this.

Analytical cookies:
Google Analytics: these cookies monitor statistics and visitor behaviour; the information is anonymised. To safeguard your privacy, we use Google Analytics in our website in accordance with the instructions of the Dutch Data Protection Authority (15 August 2018), so that there are no or only slight consequences for your privacy. Your permission is therefore not required.


We have also concluded a processing agreement with Google, masked the final octet of the IP address, deactivated ‘data sharing’, and we do not use Google services in combination with Google Analytics cookies.

Processors/recipients

We provide personal data to third parties or agents only to the extent that it is needed for the legitimate purpose of the processing. Those who come under these categories of recipient are mostly employees, notaries, lawyers, accountants, bailiffs, the judiciary, experts, couriers/postal services, web hosts, IT service providers, and administrators.


All agents/third parties who are engaged by us, including employees and processors, have undertaken to exercise confidentiality, or are bound by the relevant legal obligations of confidentiality. Processing agreements have been made with all processors in order to safeguard the privacy of data subjects.


Your rights

Under the terms of the GDPR, you have the right to view your personal data and to have it corrected. In some cases, you may also request that your personal data be deleted or that the use thereof be restricted, or object to it being used. If you have given your consent for your personal data to be used for a specific purpose, you may withdraw said consent at any time. If you have provided personal data to us, you have in certain cases the right to obtain this personal data in a form/file that allows you to easily pass it on to another organisation. To exercise any of these rights, you may send us a written request. It should be pointed out, however, that legislation allows a number of exceptions to the aforementioned rights. You also have the right to put complaints to the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).


We will treat any requests in accordance with the applicable legislation. We may ask you to come to our offices to provide proof of your identity. If a request is rejected, we will of course explain the reasons why.
